1.    Reminders

 

1.1 This website is owned and operated by International Risk Compliance Association (“IRCA” or “we”).  We are to collect, use, share, store and protect the information provided by you via this website.  This Privacy Policy does not pertain to information that is collected offline or to information that is posted by third parties.  When this policy mentions “IRCA,” “we,” “us,” or “our,” it refers to the International Risk Compliance Association who is responsible for your information under this Privacy Policy (the “Data Controller”).

 

1.2 When accessing or using this website, It is your responsibility to read and accept the terms and conditions of this Privacy Policy.  by using any of our services, you agree to be bound by the terms and conditions of this privacy policy.  if you do not AGREE TO all or part of THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, you should cease using the services.

 

1.3 By installing, accessing or using this website, you understand and consent that your information will be managed according to the Privacy Policy, which is incorporated into and is further subject to, the Terms of Use (“Terms”).

 

1.4 IRCA reserves the right to modify all or part of the Privacy Policy from time to time upon its posting of such modified policies.  By continuing to use our service, you agree to the updated terms which will effectively replace the original terms of the Privacy Policy once the updated terms of the Privacy Policy are posted.  The updated Privacy Policy applies to all your information and accounts.

 

1.5 Please be aware that the services provided by us may contain such material, information, hardware, devices and other functionality, which may be owned or controlled by third parties instead of IRCA and may be governed by separate privacy policies or practices.  This Privacy Policy does not cover the information practices of any other third party.

2.3.2 Please note that technical information or demographic information individually does NOT identify you personally.  In the event that we apply such information in combination with other information to identify the specific identity of natural persons, or such information is combined with Personal Information, we treat the combined information as Personal Information as long as it remains combined.  Unless with your authorization, or it is otherwise required by laws or regulations, such information will remain anonymous and the identifiable information will be removed.

 

2.4 Information from Other Sources

 

In order to provide you with better and more customized services and to jointly serve you, or for the purposes of preventing internet fraud, our Affiliates and service partners will share your information with us in accordance with the provisions of the law or with your consent.

 

Specifically, you confirm and agree that our Affiliates within or outside PRC may provide us with your Personal Information and other account information stored with our Affiliates in order to serve one or multiple functions of our website or our services, or provide your Personal Information or account information in any other circumstances as provided in the Terms.

 

2.5 You understand that failure to provide certain information to us may cause you unable to use our services sometimes, and we will not be responsible for any consequences caused.  IF YOU DO NOT WANT US TO COLLECT YOUR PERSONAL INFORMATION, PLEASE DO NOT PROVIDE THEM TO US.

 

3.    Use of Information

 

3.1 We use your information collected via this website primarily for the following purposes:

 

3.1.1 To provide services requested by you;

 

3.1.2 IRCA may transfer that information to its Affiliates or other third parties, across borders, but IRCA will keep such information anonymous, or remove the identifiable information that is necessarily required by the law;

 

3.1.3 To keep you posted on special offers and promotional events, and other new services, or to forward promotional materials to you;

 

3.1.4 To complete your payment.  We may collect from you your credit card number, payment account number, billing address and other information related to such orders, and we may use such collected information to fulfill your payment;

 

3.1.5 To send important notices, such as changes to our terms, conditions, and policies, including but not limited to this Privacy Policy or the Terms, if necessary;

 

3.1.6 To contact you in response to inquiries, or to provide feedback to your requests;


3.1.7 To help us develop and improve our services;

 

3.1.8 To verify your identity and compare information for accuracy;

 

3.1.9 To protect the interests of both user and IRCA, especially enforce the Terms and prevent infringement and fraudulence;

4.    Share and Disclosure of Information

 

4.1 Except as described in this Privacy Policy or at the time we request the information, we do not otherwise use, share or otherwise disclose your information to any third parties for their marketing purposes.  You hereby consent and authorize us to disclose your information to such third party under the following circumstances without your further consents (under these circumstances, it is necessary for the adequate performance of the contract between you and us):

 

4.1.1 We may share and disclose your information with IRCA Affiliates, partner service providers and/or agents.

 

To fulfill a service provided by IRCA to you, or to deal with any disputes or claims between you and a third party, IRCA may share and disclose your information with its Affiliates, partner service providers and/or agents, in order to provide you with services that has been requested by you, or so that we can ensure that our services are meeting your needs, e.g. sending postal mails, e-mail or text message, provision of marketing assistance, market research or customer services, management of the user’s membership, or any promotional activities you participate.

 

4.1.2 We may share and disclose your information with unaffiliated third-party service providers, agents or independent contractors.

 

To unaffiliated third-party service providers, agents or independent contractors who help us maintain this website, and provide other administrative services to us (including, but not limited to, providing user service, maintaining and analyzing data, and sending customer communications on IRCA's behalf).

 

4.1.3 We may share and disclose your information with the judicial department, law-enforcing department or government authorities according to legal requirements.

 

To comply with the laws or in the good faith belief that such action is necessary in order to conform to the requirements of laws or comply with legal process served on us, protect and defend our rights or property, including the rights and property of IRCA or act in urgent circumstances to protect the personal safety of our end users.  We may also disclose your information if we determine that for purposes of national security, law enforcement, or public safety, disclosure is necessary or appropriate.

 

To facilitate the communication to an appropriate judicial, law enforcement or government authority who lawfully requests such information of the personal data and/or communications content.  Reasonable assistance and information to satisfy such request will be provided by IRCA and its Affiliates and you hereby irrevocably agree to such disclosure.  In addition, IRCA reserves the right to disclose your information when we believe such disclosure is required to comply with the law, judicial proceeding, court order or another legal process.

 

4.1.4 We may share and disclose your information with a third party involved in corporate reorganizations.

 

To third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.

 

4.1.5 We may share and disclose your information with the third party related to your problem.

 

If you email us a problem, we may use your email address to process your request and respond to your problem.  When your problem involves a third party, we may share your necessary information with the party to solve your problem.

 

4.1.6 We may share and disclose your information with a third party to complete the payment.

 

We may also provide such information, or other Personal Information provided by you, to unaffiliated third parties as necessary to complete your payment (for example, to process

 

4.1.7 We may share and disclose your information with a third party to avoid potential fraud risks.

 

To protect against potential fraud, we may verify with third parties the information collected during the use of this website.  In the course of such verification, we may receive information about you from such services and may share and disclose such information.

If we determine that disclosure is reasonably and/or necessary to enforce the Terms or to protect our normal operations, or if required by laws to protect the legitimate interests of other users.

4.2 Please note that we will not be responsible for any additional information you provide directly to any third parties, and IRCA shall not be held liable for your losses in such cases.  These providers have limited access to your information to perform these tasks on our behalf and are contractually bound to protect and to use it only for the purposes for which it was disclosed and consistent with this Privacy Policy.

 

5.    Your Rights

 

5.1 You may exercise any of the rights described in this section before your applicable Data Controller and Payments Data Controller by sending an email to admin@compliance.com.cn.  Please note that we may ask you to verify your identity before taking further action on your request.

 

5.1.1 Managing Your Information

You may access and update some of your information through your Account settings.  You are responsible for keeping your personal information up-to-date.

 

5.1.2 Rectification of Inaccurate or Incomplete Information

 

You have the right to ask us to correct inaccurate or incomplete personal information concerning you (and which you cannot update yourself within your IRCA Account).

 

5.1.3 Data Access and Portability

 

In some jurisdictions, applicable laws may entitle you to request copies of your personal information held by us.  You may also be entitled to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).

 

5.1.4 Data Retention and Erasure

 

We generally retain your personal information for as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations.  If you no longer want us to use your information to provide the IRCA Service to you, you can request that we erase your personal information and close your IRCA Account.  Please note that if you request the erasure of your personal information:

 

We will cease to provide you with any services.

 

We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety.  For example, if we suspend an IRCA Account for fraud or safety reasons, we may retain certain information from that IRCA Account to prevent that Member from opening a new Orange Account in the future.

 

We may retain and use your personal information to the extent necessary to comply with our legal obligations.  For example, IRCA may keep some of your information for tax, legal reporting and auditing obligations.

 

Even after your IRCA Account is canceled, some copies of your information (e.g., log records) may remain in our database but are disassociated from personal identifiers.

 

Because we maintain the IRCA Platform to protect from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.

 

5.1.5 Withdrawing Consent and Restriction of Processing

 

Where you have provided your consent to the processing of your personal information by IRCA you may withdraw your consent at any time by changing your Account settings or by sending a communication to IRCA specifying which consent you are withdrawing.  Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.  Additionally, in some jurisdictions, applicable laws may give you the right to limit the ways in which we use your personal information, in particular, where (i) you contest the accuracy of your personal information; (ii) the processing is unlawful and you oppose the erasure of your personal information; (iii) we no longer need your personal information for the purposes of the processing, but you require the information for the establishment, exercise or defense of legal claims; or (iv) you have objected to the processing pursuant to Section 5.1.6 and pending the verification whether the legitimate grounds of IRCA override your own.

 

If you want to withdraw your consent, you may, at any time ask IRCA to cease processing your data by sending an e-mail to admin@compliance.com.cn.

 

5.1.6 Objection to Processing

 

In some jurisdictions, applicable laws may entitle you to require IRCA not to process your personal information for certain specific purposes (including profiling) where such processing is based on legitimate interest.  If you object to such processing IRCA will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing, or such processing is required for the establishment, exercise or defense of legal claims.

 

Where your personal information is processed for direct marketing purposes, you may, at any time ask IRCA to cease processing your data for these direct marketing purposes by sending an e-mail to admin@compliance.com.cn.

 

5.1.7 Lodging Complaints

 

You have the right to lodge complaints about the data processing activities carried out by IRCA before the competent data protection authorities.

 

6.    Storage and Protection of Information

 

6.1 To facilitate our global operations IRCA may store your personal information on the servers located in Europe, Asia Pacific, North America, and Oceania.  As to information collected within the territory of PRC (Except Hong Kong, Macao, and Taiwan), it may be stored outside PRC under the following circumstances:

 

In accordance with explicit provisions in the laws and regulations;

 

With your explicit authorization;

 

Your personal actions such as cross-border transactions via the internet.

 

6.2 IRCA will employ reasonable and feasible security methods that conform to the industry standard to protect the information provided by you according to applicable laws and regulations against loss, theft, and mishandling, or unauthorized access, disclosure, modification, and destruction.  Your information is cautiously stored and can only be accessible by authorized employees of IRCA or third parties to whom such access is necessary to fulfill their obligations.

 

6.3 Your account is equipped with security protection functions.  Please keep your account and password information safe and secure.  If you find your Information, especially the account or password is disclosed, please contact us immediately so that we can take the appropriate measures upon your application.  In the meantime, we may report the actions taken to the personal information security incident in accordance with the relevant regulatory requirements.

 

7. Transboundary Transfer of Information

 

7.1 To facilitate our global operations IRCA may transfer, store, and process your information with service providers based in Europe, Asia Pacific, North America, and Oceania.  Laws in these countries may differ from the laws applicable to your Country of Residence.  For example, information collected within the EEA may be transferred, stored, and processed outside of the EEA for the purposes described in this Privacy Policy.  Where we transfer, store and process your personal information outside of the EEA, we have ensured that appropriate safeguards are in place to ensure an adequate level of data protection.

 

 

7.2 You understand and agree to transfer your information to other countries and regions which do not have the same data protection laws as PRC, EEA, and USA.

 

8. Protection of Minor

 

IRCA will not deliberately collect or solicit Personal Information from anyone under the age of 18 (“Minor”) or allow such Minor to register his/her own user account or to use any of the services on this website.  If it comes to our knowledge that we have collected any Personal Information from a Minor, we will promptly take steps to remove such personal information.

 

9. Third-Party Websites

 

For the convenience of your use of services, you will have access to certain contents or internet links provided by other companies, organizations, or any other third parties (including IRCA’s Affiliates) instead of IRCA.  You can choose to access such contents or links, or use services or products provided by such third party.  However, you understand and agree to bear all the risks arising from such access or use, since such third party is not controlled by us, and nor will we be able to manage the Personal Information accessed or stored by such third party.   You acknowledge that this Privacy Policy applies solely to information collected by IRCA via this website and does not apply to any information that you choose to provide to such third party by yourself.  You are highly encouraged to learn about the privacy practices of those third parties in advance to prevent unintentional submission of any of your Personal Information.

 

 

 

10. Changes to this Privacy Policy

 

10.1 We reserve the right to change this Privacy Policy from time to time. When we do, we will also revise the "last updated" date at the bottom of this Privacy Policy.  We will also provide you with notice of the modification by email at least thirty (30) days before the date they become effective.

 

10.2 You agree that your continued use of this website shall constitute you have read, fully understand and accept the new version of Privacy Policy.  If you disagree with the revised Privacy Policy, you may cancel your Account.  If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access or use of the IRCA Platform will constitute acceptance of the revised Privacy Policy.  You are encouraged to periodically review this Privacy Policy in order to note how IRCA is collecting, using, and protecting your information.

 

11. Security Statement

 

11.1 You understand that IRCA cannot guarantee the security or confidentiality of the information you provide to us in all circumstances.  Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to IRCA is done at your own risk.

 

11.2 Once we receive your transmission, we make reasonable efforts to ensure security on our systems in accordance with this Privacy Policy.  We use firewalls to protect your information against unauthorized access, disclosure, alteration, or destruction.  However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.

 

11.3 In case of any security system breach, we may attempt to notify you electronically so that you can take appropriate protective steps.  By using this website or providing Personal Information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of this website.  We may post a notice on our website and/or send notices to you through multiple methods including email if you have provided us with your email address if a security breach occurs.

 

12. Disclaimer

 

12.1 IRCA or its Affiliates, or their respective employees, officers and agents shall not be liable for any disclosure under the following circumstances:

 

Any disclosure of your Personal Information as required by law or relevant governmental authority;

 

Any disclosure of your Personal Information caused by your own voluntary or negligent acts;

 

Any disclosure of your Personal Information resulting from hackers, computer viruses or temporary closure of this website; or

 

Any disclosure of your Personal Information resulting from force majeure beyond IRCA’s control.

 

12.2 You acknowledge and understand that, although we have taken reasonable measures, schemes and devises that are adapted to the services according to the relevant data protection laws and mandatory technical standards, and have established a User Data processing system, a comprehensive User Data management system, and necessary traceability system, and continuously undertake information management responsibilities, we may not guarantee the avoidance all the leaks, losses, falsifications, improper uses or other information security/privacy violation events caused by a third party or other reasons.

 

UNLESS IT IS OTHERWISE COMPULSORILY REQUIRED BY LAWS, YOU AGREE THAT IF THE AFORESAID EVENTS ARE NOT CAUSED DUE TO OUR INTENTIONAL BREACH OR MATERIAL NEGLIGENCE, IRCA SHALL THEREFORE BEAR NO LIABILITY FOR ANY DAMAGE COMPENSATIONS OR BREACH OF THE CONTRACT.

13. Dispute Settlement

 

If you continue to use services provided on this website, any dispute over Personal Information is subject to this Privacy Policy and the provisions of the Terms, including but not limited to dispute settlement, and the application of Laws of PRC as the governing law.

 

14. Effectiveness and Amendment

 

The Privacy Policy is made in both Chinese and English, in case of any discrepancy, the Chinese version shall prevail.
